Reading Klayman's comments it did seem to that there had been a hearing this week on discovery. Wish we had an unbirfered account of what happened.

There was indeed a hearing held yesterday, as Klayman reported.

I would not bet my life on it happening *exactly* as he portrayed it, however.

It was not reported nor recorded, unless a freelance reporter was hired by one of the parties, and I doubt they would have for a simple, short motions hearing. Though admittedly I do not know for certain. So..... except for waiting to see what happens down the road, there's no way except by direct contact with the attorneys involved, which I do not have, to know what took place.

Methinks There's going to be a serious birther breakdown following that hearing. Not because the judge is going to opine on nbc, but because the hearing has nothing to do with it. Like Orly and Irion, however, Klayman is not going to tell them the truth, as that would slow the PayPal. He'll just scream foul/corruption/bought off afterward.

I am beginning to understand "Birferlaw" . What I now know is that if a "Democrat" challenges President Obama it is so much more significant than if someone else does. I assume that the Judge will take Judicial Notice of this fact and it will heavily influence his decision.

Reading in between the lines of the report of the hearing on obamaballotchallange.com, it appears that the Judge granted the motions to stay the discovery that the Klayman had plan to take. That discovery was to begin in the week of June 18. Instead we have a hearing on the motions to dismiss on June 18. In the usual course of litigation that I am familiar with (not Florida though), if a stay of discovery is requested while a dispositive motion is being considered by the court, it is usually granted. Just my guess here.

Do we have a clear idea as to the legal question that this judge must decide? Birthers think that his task is to define natural born citizen. I doubt that. The relative absence of copies of items on the docket is a real problem.

Judging from the docket, it appears the hearing would concern the various motions to dismiss. If those are granted, the rest is moot.

This is, of course, exactly why discovery stays are generally granted when dispositive motions are on the table. There is no point burdening the parties with a case that will never happen. This is clearly a frivolous case that will never go forward (said Captain Obvious).
