Mario has spent much of last night and this morning posting on Doc C's, declaring victory in his appeal

Tarrant... which thread at Doc's? I've skimmed three threads that I thought might be the appropriate ones and did not see any comment by The Putz. :((

It's the "New Jersey: Purpura Appeal Filed" thread. It was lightly posted in until Mario showed up a week or so ago then it exploded, he's still posting in it post-hearing.

http://www.obamaconspiracy.org/2012/05/ ... eal-filed/

Enjoy :)

Thanks to both of you. :-bd

Everything is a victory for Mario.

He's still not admitted that he lost the Kerchner case.

He didn't lose the Kerchner case. He just came second.

Sound was awful sadly. Could not hear a thing.

It is painful to watch Mario argue before the panel. Such a display of utter incompetence and sheer stupidity and a lack of mental clarity I have not seen in a long time. He's the epitome of blithering idiot. His talk bounces all over, with no direction, no apparent objective - pointless sentences strung together and blurted out. And the judges' questions easily send him off into a tangent.... that get lost and goes nowhere. Mario's blathering shows clearly that he has no idea what he is talking about, that he is mentally incompetent. He's kooksville.

But...rather then have pity on the pathetic creature, I urge defense counsel take an aggressive approach - don't simply rebut the silly "arguments" by Apuzzo, file motions with courts that Apuzzo afflicts with his nonsense that they must recognize that he and his client are vex lits, on a political propaganda harassment - nothing more, nothing less.
Ask courts to Strunk him. Otherwise, Putz will foul courts with his garbage and will perpetuate his stupidity forever.

I've not yet looked for an actual opinion, but will in just a minute.

According to a poster at Doc C's...

Quote:
Author: Northland10
Comment:
"These arguments are without merit," NJ Appellant Court, May 31, 2012.

The court ruled against Mario, essentially saying, "what the ALJ said."

Edited to Add:

Quote:
We have carefully considered appellants' arguments and
conclude that these arguments are without merit. R. 2:11-
3(e)(1)(E). We affirm substantially for the reasons set forth
in ALJ Jeff S. Masin's thorough and thoughtful written opinion
of April 10, 2012, as adopted by the Secretary on April 12,
2012.
Affirmed.

NJ - 21-12-05-31 - PURPURA|MORAN - APPELLATE DECISION (Affirmed)

Opinion to be posted in just a few...

It was short, sweet and to the point...wish they'd have pounded Mario harder!

I guess Mario will be declaring victory (or at least not conceding defeat) because the ruling doesn't include a detailed analysis and rejection of his two-citizen-parent nonsense. It says the whole case was without merit.

Well, the ruling does mention that:

Quote:
The Secretary affirmed and incorporated the decision of the ALJ, concluding, after a full hearing, that "[appellants] failed to meet their burden to establish that Barack Obama failed in any obligation to prove to the Secretary of State that he is qualified to hold the Presidency and that he is a 'natural born Citizen' of the United States of America, as required by the United States Constitution."

I nominate their use of the words "without merit" as Euphemism of the Year.

Just so you realize what a benchslap this actually is, R. 2:11-3(e)(1)(E) states:

R. 2:11-3(e)(1)(E) wrote:
(e) Affirmance Without Opinion:

(1) Civil Appeals. When in a civil appeal the Appellate Division determines that any one or more of the following circumstances exists and is dispositive of a matter submitted to the court for decision:

[. . .]

(E) that some or all of the arguments made are without sufficient merit to warrant discussion in a written opinion;

then and in any such case the judgment or order under appeal may be affirmed without opinion and by an order quoting the applicable paragraph of this rule.

It must suck to be Mario Apuzzo. Oh, I know he'll attempt to weasel-word this crushing defeat as signifying something other than the obvious. But there you have it.

And even though the ruling is designated not-for-publication or citation, it still has the practical effect of elevating the ALJ's original opinion.

Thanks for contributing this nice new morsel to our increasingly lengthy string cite, Mario! Oh, and good luck peddling this turd to SCOTUS once the NJ Supremes summarily deny review.

I've not gotten that far, but what I heard was basically the Respondents' positions/argument were absurd.
