I dunno how it works down in Arid Zona, but here in Oreegun the D.A. files the charges. Law enforcement merely issues the citation or throws the culprit in jail pending a bond hearing and then supplies the facts as he saw them to the D.A.


Sometimes they have a Real Grand Jury hearing, too. Also.

I know I'm beating a dead horse here, but no one cares what eyewitness they spoke to or didn't speak to. A "certificate" is by definition a statement from a government agency, and nothing more. What these people are doing by analyzing the PDF of the certificate is simply claiming that the Hawaii Department of Health is not saying what that certificate says it does.

On its face that is an absurd proposition. The DOH says Obama was born in Hawaii. If they want to challenge the DOH on that contention, by all means go ahead. But to challenge whether the DOH even says he was born in Hawaii is an argument that will only persuade illiterate people and people who aren't paying attention (because they don't care, which is most people).

Absolutely. Starting with the COLB, the focus has been on the detailed characteristics of paper birth certificates, and there was much speculation about how various documents would hold up under various forms of forensic analysis.

But we've gotten way beyond that point. What the birfers fail to acknowledge is that birth certificates, like all other official documents, are in fact surrogates. They represent what custodial officials would say if asked what information was in the official records of the state (which are themselves guaranteed by the Full Faith and Credit clause). They save us the trouble of contacting Departments of Health every time we need to know when and where someone was born.

Now that Hawaiian officials have attested to the President's date and place of birth, it doesn't matter if the certificate itself is written with crayon on toilet paper (I believe I've said that here before). The information therein has been established to a legal certainty.

Except that the notion that Obama lackeys are intimidating the media is entirely separable from the reliability of the certificate. It's conceivable that Obama hates the Birther meme so much that he's still intimidating the media away from covering it, threatening people's jobs and family members.

Conceivable yes, but still stupid. And entirely unevidenced. It's interesting to watch it play out when it comes up, because there's no pseudoscientific or pseudolegal nonsense to fall back on. They claim that people have been intimidated. Can they say who? No. Can they say where? No. Can they say when? No. Do they have any documentation? No. All they have is 3-year-old hearsay from Hagmann, and their own speculation. But nothing can shake their faith that something some guy said three years ago, and then never substantiated, is the gospel truth.
