I love the way that counsel points out the 9, 11, 10 thing with the liberal use of (sic). That is a lawyer's favorite tool for pointing out to the Court that the pleadings are fucked up, and "hey we are just responding to the bullshit that was filed".

Offtopic :

We once received a set of interrogatories from an Insurance defense firm that were requesting medical records including "doctors, nurses, and thisapist" records. I laughed myself silly and did a snarky response to them and served them on opposing counsel (with a proper response as well) littered with "thisapist (sic) records" all the way through. Counsel called me and told me that his new secretary had overtyped some old Rogs (that were addressed to a female) and done a "find and replace" for "her" with "his" and had no idea what the result had been. Apparently she was let go a short time later and said "thank God, I HATE this job"

Resort by who the mail is from and set a timer to 15 or 20 minutes. (I like the old fashioned cooking timers with the dial you turn. ) It's easier if you resort by "from". You'll have a big chunk of that cleaned out within a week. I have to force myself to do this every once in awhile after I've ignored it too long, and this is the method I use.

This is threatening to go to threadjack really fast, and it's a discussion I really need to be having, because it's stuff I'm working on now. I'm going to quote the post and reply in a new thread.

It's a stock line to throw in a request for costs in the answer. But what's meant by "costs" in this context are a subset of expenses directly necessary to proceed with the claim or the defense in court. In most jurisdictions, judges may award costs (subject to abuse of discretion) to the prevailing party. Costs include stuff like filing fees, process servers, transcripts, postage and the like. Costs do not include attorney's fees or first class tickets for Tepperators. In this case, defendants' costs might add up to a few hundred quid and not much more.

If, however, the Court were to award expenses and fees for sanctionable litigation misconduct, Orly could find herself on a much stickier wicket.

What is good about an answer versus motion to dismiss, it that it shows that the complaint has merit and parties go into discovery.

I might be wrong, but I believe this is the first time that the Secretary of State and Democratic party file actual answers. I will be preparing subpoenas for deposition and production of documents. One wild guess, who is number#1 on my list for subpoenas for deposition and production of documents???
