Ms. Hill, counsel for OFA, handled her part pretty well, keeping Apuzzo from unloading all the crazy poop from birferstani manure piles, keeping the proceedings about NJ statutes.
This Judge knew what he was doing. He let Apuzzo talk, let him present his "case", and chopped it up at every step.
He shut down and finally chased Purpura off the witness stand when the obnoxious jerk tried to play Prosecutor.
Judge correctly ruled on the quality of their "evidence", he heard their arguments, found them to be unpersuasive.

This hearing and this ruling (this recommendation to SoS) completely shredded the birther arguments with a coarse grater.

At 8:55 of the 3rd clip, Apuzzo reads aloud some crap he wants to introduce as "evidence" about somebody publicly said "Obama was born in Kenya", then he looks up from reading and says rhetorically "Is this true ? I don't know, but.."
Judge interrupts him "You Don't KNOW ?!?! "
Apuzzo:" nmh, nmh, nmh....no...but you have to look at the totality....the totality....."
And Ms. Hill and then the Judge shreds Apuzzo for trying to introduce what the Judge calls "rumor, innuendo, suspicions.."
So Apuzzo's next move is to introduce an affadavit from Tim Adams about his suspicions that Hawaii DoH has no records for Obama.....Ms. Hill objects, Judge castigates Apuzzo again, and rules this affadavit is utter bullshit hearsay.

Mario's lengthy blathering on English Common Law and how the Founders defined NBC blah blah blah...is....mind boggling.
He contradicts himself and talks in circles and gets lost.
I've seen drug addicts who are swacked out of their skulls who argue more cogently and make more sense.
The man is incoherent. My guess is he is an addle brained drunk.

The Judge several times asks the same question the NH Elections Commissioner asked of Orly - "Has any court ruled that [President Obama] is not a NBC ?"
Apuzzo: "No, but....." then tries to lie about the ruling in Ankeny and Tisdale and the Malihi decision ruling.....to a judge who obviously knows the cases...and the Judge takes it upon himself to Again correct Mario.....

And Ms. Hill reads a few of the many cases that clearly define NBC..(making Purpura grit his teeth so hard his cell phone goes off)...

This was a Major Slicing and Dicing and Smackdown of each little piece.

Change the name of birferstan to Barfostan. They are truly a nauseating people fouling up and abusing the courts. These people are in need of serious psychiatric help.

This case and this ruling will be good precedent. The video and ruling should be sent to every subsequent birther case to add to the "Totality".

Many lawyers, having come to their careers from a love of hearing their own voice, go through an entire career without ever realizing the simple fact that sometimes the very best argument is none at all. Just let the idiots on the other side destroy themselves.

BUT - she was prepared, stayed alert to what the plaintiff was dishing out. She had a clear understanding and command of her arguments and objections, and she knew what the plaintiffs would be doing. She handled it well, IMO.
She's 50x the attorney Apuzzo ever could be.

Correct me if I'm wrong, lawyers, but this is another administrative ruling by an ALJ for the state. It doesn't carry the same weight as a case in a judicial setting. It's great stuff and will be used against birferz elsewhere...just not the same way. The NJ Secstate approved the ALJ opinion, making it the final decision of the executive dept in NJ, and now it can be appealed in court, where, how much of the alj case becomes part of the record to be argued and how much must be argued anew?

Listening to Apuzzo speak, one has to wonder if he is brain-damaged.

The best was in the 2nd clip when the putz tried to introduce the Secret Service Card and said it was a forgery based on the Arpaio investigation. The judge asked if Arpaio or anyone of his team was there to testify and provide evidence, and the putz hemmed and hawed about the whole thing. the judge even warned the putz that making such an accusation without bringing proof is not a path he should go down.

The judge pretty much shut him down.

That was just in his opening statement. His performance in front of the judge was pretty much the same. Talk in circles, use words that didn't mean what everyone thought they meant, jumped from subject to subject that contradicted each other.

The best is in the second clip when he brought up Stanley's passport record, the school record and then Obamas Yearbook. His arguments were just a circle end jerk of contradiction.\

I think he has some kind of speech impediment. Add to that the addled brain AND the lower class NJ accent ("true" for "through", "trow" for "throw", etc.) and you get Mario's oral delivery. The first time I heard him on the radio with Kerchner, I thought Kerchner was the lawyer and Mario the client.

Unfortunately for Mario Judge Masin had actually read Wong Kim Ark, had read Ankeny, and had read Judge Malihi's decision. I think he even said he knew Judge Malihi if I heard correctly.

When the judge was skewering "Apozo" on the Kenyan legislator's statement, he said for all he knew, the legislator could have gotten his information from a "birther site."

haha, in the middle of the putz's NBC circle jerk, Judge Masin asked "Do you know Wong Kim Ark"
and the putz goes on to misrepresent what Wong Kim stated (that he was born a citizen because his parents were domiciled)

The Judge asks, where in the decision does it say that?

What kind of lawyer turns up to argue the definition of NBC, intending to argue that it does not say what it has been held to say, but does not bring a copy with him?
