You will recall that after his case was dismissed last week Scheller filed a post trial motion. Well no surprise but the court has ruled - no way.

The Motion for Continuance was denied by the court. I think we're still on for 3/19.

Berg should get sanctions. IIRC, the last time the judge let him off the hook. I forget the exact language, but it had to do with Hemenway.

IIRC, Berg was not sanctioned for his shadowy role in Hollister because he made no appearance and therefore the Court did not have disciplinary jurisdiction over him.

The attorney for Hollister was John D. Hemenway who was the stand in for Berg. Hemenway was reprimanded but no monetary sanctions were imposed in the end. Here is a link to Doc C's article with the order.

That's the one. The judge talked about Berg a few times in that order, and even the very last page has Berg on it.

Yes, Judge Roberts said if Berg had been before him his ass would be sanctioned. Hemenway is the FIL of Birther Margaret Hemenway. I haven't heard much from her lately. She worked in the Bush II administration at DoD and NASA. I think she attended the Lakin trial.

One generally moves to strike an improper pleading paper. I wonder if this is hinting at a motion for sanctions in Berg's future. It would be well-timed considering the pending bar proceedings.

I was planning to go to the Commonwealth Court yesterday to get any documents we are missing in the PA cases. But I haven't been able to check the dockets for any of the cases to see what I need to get - every time I try (at home and work) I get an error message. I'm also getting the same error when I check the PA Superior court docket, so I suspect it is a problem on their end.

If anyone has an idea of the docs we don't have let me know. I was going to get the application to strike in Berg's case, but I think there were some docs in Kerchner that I hadn't gotten yet. It isn't too far to go, but the poor clerk was so frazzled when I was getting the other documents that I would like to make just one trip for everything if I can.

I am still planning on going to the hearing next week (if it happens). I have a meeting that night at 6:30 so my report back may be delayed until after the meeting.

Well, that's good. Striking means that not only did the pleading have no merit, it shouldn't have even been filed and will not be allowed to sully the docket any further.

This is always helpful when filing a motion for sanctions. Perhaps there will be a hearing on that motion, should the opponent file one.
