The status quo ante is that Obama is on the ballot. Appellants seek to remove him from the ballot. To characterize the issue as "keeping" him on the ballot is an exercise in polemics. Appellants either prevail in their attempt at removal or they don't and THAT is the central issue.

Given that backdrop, I submit that defendant may raise the issue of SMJ (or not) and the reviewing court can find jurisdiction or not. If the latter, it's over. Think about it. If the superior court does not have SMJ to take Obama off the ballot (for arguably the same reason that the ALJ had no jurisdiction), the result is the same.

Where, as here, the outcome effects a primarily public interest, I just cannot see how a court would deviate from the general principle that SMJ may be raised at any time by estopping a party from raising it and then blindly granting a remedy it does not have authority to grant.

Farrar has not disassociated with Orly. He wrote a letter trying to disassociate himself from her accusations of criminal behavior in the letter she wrote to SoS Kemp. That's all.

He's still her "plaintiff" and she'll be representing him in his failed appeal, I'm certain.
