On the morning of December 7, Fitzpatrick had attended the selection of the two Monroe County grand juries for 2012, and following his reincarceration, stated in a letter dated December 14 that the jurors were “hand-picked” by Judge Amy Reedy.

To Gov. Haslam and all others concerned:

To say I am distressed would be an understatement! Today we visited a friend at the Monroe County, TN. Jail. This man, Walter Fitzpatrick, is a retired Lt. Commander in the Navy. Now he is forced to sleep on a damp floor in the day room of the jail – no water – no bathroom and he is a diabetic with an ulcer on his heel. He was denied a shower for 24 days until the nurses ordered he be allowed to have a shower. Now, again 2 weeks gone by and no shower.

What was his humongous crime that warrants this treatment you ask…..OK you didn’t ask, but I will tell you anyway. He had uncovered the grand jury illegalities and attempted a citizen’s arrest of the grand jury foreman in the courtroom. The same man had been appointed and re-appointed as foreman for 27 consecutive years. Deputies proceeded to arrest Walter instead. Walter fired his attorney because the attorney was threatened and intimidated by a judge. He reported to the clerk of the court that all correspondence be sent to him personally. She either forgot or disregarded this and he did not receive a notice for a court hearing. This absence brought out a team of 3 detectives – no uniforms – and an unmarked car in sight of his door, but up a little hill. He started to head to his landlord’s house. Just by chance he glanced over his shoulder to see 3 men attacking him from the rear. He ran back into his house at which time they kicked in the door and attacked him physically and yes, he fought back. One deputy came close to taking his ear off. He was tasered several times and taken to jail. All of this, because a clerk neglected to inform him of a date for a court appearance. I, personally witnessed the trial. What I witnessed was a miscarriage of justice. The judge allowed a deputy who was a witness to stay in the court room listening to testimony. Highly irregular! The jury found him guilty of resisting arrest, but not on the assault charge.

At the sentencing, Walter read a statement that the court had no jurisdiction because of faulty jury selection. The judge sentenced him to 6 months. On Dec. 3rd….approximately 60 days before completion of sentence, he was released. On Dec. 7th he observed the picking of the grand jury. That night 7 deputies again kicked in his door – guns drawn – and said he had been released too early and also he had taken some papers from the courthouse. The swat team use was excessive. Did they need practice so badly that they used the Commander for this purpose? They ransacked his home, took his computer and a multitude of other items. The door was broken again. His major crime that day was to observe the judge hand picking the jurors. Isn’t the jury supposed to be picked randomly to assure as much as possible a fair and impartial jury? When the jury works directly for the court system an innocent person doesn’t stand a chance. That, sirs, is why he is sleeping on the floor and deprived of the necessary showers for his health.

This is very very bad behavior for a diabetic. With the ulcer on his heel and his abuse of his skin will result in Wally starting to lose toes, then feet, then fingers, etc. He does need help, but in a hospital where he can relax.

Unfortunately for FilchPatrick, he will never even recognize that he has serious mental problems. His lengthy history of domestic batteries against women reflects this.

While it is sad that he is, himself, the victim of his own disgusting criminal behavior, I frankly find it hard to care.

I hope upon his release from confinement for his crimes that he quits committing new crimes and focuses on his own health. If he doesn't, though, that's his own problem.

AMID CONCERNS FOR HEALTH AND WELFARE

The Post & Email has learned that a hearing originally scheduled for January 10 for Walter Francis Fitzpatrick, III did not take place, but a court date has been set for Tuesday, January 17, 2012. A reader of The Post & Email was told that Fitzpatrick went to the courthouse briefly on January 10 to “get some papers” in preparation for next week’s hearing.

The Post & Email called the TCI at 11:44 a.m. ET today and asked for [the TCI director]. We were asked for our name, and we stated such and that we were from the media. We were put on hold for about a minute, after which we were informed that [the director] was “unavailable.” We were then asked if we were calling about a matter involving an email about “Monroe County.” We responded that the email was sent by a reader of the newspaper rather than by anyone on our staff, but that that was indeed our concern.

The receptionist said, “I’ve spoken to you before,” which might have been true, as we had contacted the TCI about Monroe County jail conditions in early November and spoken with [an inspector]. At first [the inspector] had been reluctant to answer our questions, stating that he had to check first with [the director], but he did return our call later that day.

To give the receptionist an idea of the nature of our call, we mentioned the raw sewage which has been reported on the floor of the day room; the inmates sleeping on the floor; Fitzpatrick’s foot ulcer and lack of a shower for 24 days, and overcrowded conditions. In response to the claim of raw sewage on the floor, the receptionist said, “You must have been misinformed, because they don’t know when we’re coming.”

While we have not seen it for ourselves, we suggested to the receptionist that perhaps the inspection team is not being shown the entire facility when they arrive at the jail unannounced. We also mentioned that an inmate with a diabetic foot ulcer did not shower for 24 days until the nurses insisted on it. The receptionist responded that she is not the individual to whom we should be speaking about the jail conditions.

But enough about Fitzpatrick; let's get to the real star, Rondeau!:

[...]Please call Governor Haslam’s office today. Don’t put it off. I spoke with Nathan who seemed not only genuinely concerned; but promised to spend some time with the Governor on this issue. We need a lot of calls and a lot of ‘gentle’ pressure to hit them all at once and to continue unabated. I plan to call every day or so asking why he is still there and in imminent danger. The phone number is: xxxxx. We can talk about it and email and post comments OR we can call the Governor every day until he does the right thing. We are not asking his office to check into it…we are demanding the Governor personally releases him NOW. And then conduct the proper investigation and removal of corrupt officials after Walt is safely free of their grasp and control.

Impress upon them that the Governor has the authority and should intervene swiftly and directly to RELEASE WALTER IMMEDIATELY. He should personally go to the jail, see the conditions and Walt’s condition for himself and walk him out of there under his protection. Nothing less is good enough at this point nor acceptable.

Follow up with calls asking why he has not been released until Walter walks out a free man. Don’t accept the excuse that they have separation of powers, yada yada…the Governor has the authority. If a Governor (Haley Barbour..for instance…) can pardon 200 criminals on his way out the door, including convicted murderers, and if a Governor can pardon a convicted man on death row, Haslam can intervene on behalf of Walt and get him out of harm’s way.

Impress upon him that he cannot say he did not know…or did not see the evidence which they seem to be avoiding…that failure comprises everything from Treason, to complicity, to Misprision of Felony and more.

Does anyone know what's up with Fitzy these days? Wasn't there supposed to be a hearing earlier this week? None of the usual sites have anything - did that hearing happen?

The following report came in from a visitor to Walter Fitzpatrick this morning at the Monroe County jail. Fitzpatrick was rearrested on December 7, 2011 for allegedly under-serving his last sentence and stealing government documents.

Sgt. Mullins came in to see him yesterday from Veterans’ Affairs. His office is in the courthouse and he was sent there by the State Veterans Affairs Commission. Somebody had told them that Walter had been beaten up by jail officials. We have no idea where that came from. Walter told him, “No, that wasn’t true. ” The only problem Walter had was one of the deputies pushed him one day.

Our understanding is that Fitzpatrick is scheduled to be released on February 9 at 9:45 p.m. He was first arrested on April 1, 2010, following an attempted citizen’s arrest of then-grand jury foreman Gary Pettway, whom Fitzpatrick stated had over-served his term. Later, Fitzpatrick discovered that the Monroe County grand jury was illegally constructed by allowing jurors to serve consecutive terms. Fitzpatrick claimed that the juries were actually selected by the Chief Court Clerk, Martha M. Cook, rather than in a random manner. The Post & Email is in possession of handwritten notes provided to Fitzpatrick at his December 1, 2010 trial which contain cross-outs and checkmarks next to individuals’ names, appearing to indicate human intervention in the juror selection process. Tennessee law, or TCA, 22-2-314, states that “automated means” must be used to select jurors and that a period of 24 months must elapse before a juror can serve again.

The documents received by The Post & Email from Martha Cook have incorrect addresses for Fitzpatrick. One address reads “504 Mayes Street” and the other “504 MayeStreet.” The Post & Email does not release personal information, but we can confirm that that is not Fitzpatrick’s correct address.
