I have several attorney friends (male and female) who view the POTUS as their BFF. One particular female attorney here (my former boss) has been known to cut a bitch. Just saying.

Ya gotta go see this one. Kudos to Don Wright NC BoE General Counsel...

 http://www.orlytaitzesq.com/?p=29006

Letter e-mailed to Don Wright, Legal Counsel for the Elections Board of NC
Posted on | December 14, 2011 | No Comments

Apparently a Mr. Danny Vestal had been in contact on various occasions with the NC BoE re challenging Obama on the ballot, or what he deemed was a challenge, including wanting "also apparently) Orly to represent him in NC.

Quote:
Mr. Wright,

Can an out of state attorney represent me?

Danny Vestal

On Tue, Dec 13, 2011 at 1:50 PM, Wright, Don wrote:

Mr. Wright replied to Mr. Vestal...

Quote:
Dear Mr. Vestal,

You have filed nothing with this agency. You have sent us e-mails involving a matter filed under Hawaiian law. The North Carolina State Board of Elections does not have jurisdiction over social security numbers , the President’s birth records from another state, or whether the name he uses for legal purposes today is different from his passport records when he was a child. Finally, any question about his eligibility to be on the ballot in the future is not yet ripe as he has not been named the nominee of a political party for 2012.

Several court decisions have confirmed that he was and is qualified to hold the office of President. They have been no court decisions to the contrary.

Again we have received your e-mails, but they are not considered as filings since they are under Hawaiian law and we lack jurisdiction over the subject matter. Also I know of no provision in North Carolina law that allows the State Board of Elections to hold an emergency hearing on the qualifications of a setting U.S. President.

Don Wright

General Counsel

NC State Board of Elections

He apparently had forwarded Orly's HI crapola to NC. =))

So he whined to Orly and she sends a letter to Mr. Wright, part of which I post here. You'll have to go see the rest at Orly's or sumptin'.

Quote:
Dear Mr. Wright,
I am a licensed attorney in the state of CA. Mr. Danny Vestal asked me to assist him. I am not filing a legal action against you, Elections Board and Secretary of State in either state or federal court yet, I am simply providing you with some clarifications and requesting a hearing ](*,)

Quote:
1. your response to Mr. Vestal was an insult to human intelligence and a de facto violation of Mr. Vestal’s civil right to participate in a lawful election, which was done under the color of authority
2. Mr. Vestal forwarded to youmy complaint from the state of HI, not for you to act based on statutes of the state of HI, but to act upon evidence that Barack Hussein Obama is committing the biggest elections fraud in the history of this nation. He is running under a name, which is not legally his, he is fraudulently using a CT Social Security number xxx-xx-4425, [my redaction] which is not legally his according to E-Verify, and he is using a computer generated forgery instead of a valid birth certificate. Obama provided no evidence of any valid identification papers, which would make him eligible to be on the ballot.
3. Your statement, that courts found Obama to be eligible, is an outright lie. No court has ever reviewed this matter on the merits, no court ever found that Obama possesses any valid identification papers, All courts simply kicked the can, passed the buck and stated that they either do not have jurisdiction or plaintiffs do not have standing.

And of course the usual Orly threats which I'm sure have Mr. Wright sweating bullets.

Quote:
5. I demand an immediate hearing for me and for Danny Vestal to appear before the Secretary of State or the elections board and provide all the evidence, Mr. Obama can provide his rebuttle and a decision has to be made, if he can be on the ballot in N.C. primary. If this is not done, than you are criminally complicit in elections fraud, forgery, uttering of forged identification documents by Obama, obstruction of justice, misprision of multiple felonies and possibly treason, and a criminal complaint will be filed with all the proper agencies against you, elections board and the Secretary of state in due time.

So Taitz writes a North Carolina official and threatens to institute criminal proceedings against him if he refuses to give Taitz and her client a hearing. Perhaps someone could call the North Carolina official's attention to this California Rule of Professional Conduct (and maybe the North Carolina official will decide to write to the California State Bar):

Quote:
Rule 5-100 Threatening Criminal, Administrative, or Disciplinary Charges

(A) A member shall not threaten to present criminal, administrative, or disciplinary charges to obtain an advantage in a civil dispute.

(B) As used in paragraph (A) of this rule, the term "administrative charges" means the filing or lodging of a complaint with a federal, state, or local governmental entity which may order or recommend the loss or suspension of a license, or may impose or recommend the imposition of a fine, pecuniary sanction, or other sanction of a quasi-criminal nature but does not include filing charges with an administrative entity required by law as a condition precedent to maintaining a civil action.

(C) As used in paragraph (A) of this rule, the term "civil dispute" means a controversy or potential controversy over the rights and duties of two or more parties under civil law, whether or not an action has been commenced, and includes an administrative proceeding of a quasi-civil nature pending before a federal, state, or local governmental entity.

I trust you carefully omitted the footnote.

*Except in the case of A Konstitooshunall Krisis of Epik Proportions, as determined by a Klown Kar of Kooks.

We wouldn't want Mr. Wright to be unfairly disadvantaged by knowing the truth. Or something.

Dear Mr. Wright,

It is another gorgeous day here in North Carolina.

As per our complaint, in doing the right thing North Carolina will make great American history. :D

Do you have any status report on our request for an emergency hearing?

We are very anxious for our Country to expel this tyranny and in doing so our Country, North Carolina and people
will shine beautifully.

Good day to you.

Thank you,
Danny Vestal

Yes, it's HI law, as stated in Mr. Wright's response posted above.

Orly sez it doesn't matter. It was not sent so he'd do anything according to HI law, rather that he look at the "evidence" included and investigate, as he has to because she sez so or he's guilty of all sorts of nasty Group W Bench "stuff."

Y'know, I was wondering if this was going to be one of her "poor me, victim of thugs, feel sorry for poor, poor me" days, or one of her "vindictive bitch from Hell, everybody's going to prison forEVAR" days.

I think I figgered it out now. :P

All begun while Mr. Vestal was incarcerated.

I don't have his criminal history handy, but I would not be surprised if Orly is hooking up with a felon yet again.

I got the impression he was in prison. In general, don't you have to be convicted of a felony in order to be sent to prison (as opposed to the county jail)?

Yes. In California non violent offenders with prison sentences are now serving that time in jail for budget considerations. Perhaps budget considerations will also cause the various states to re-think incarceration as a method of punishment.

Unfortunately, the various state legislature have come under the influence of the super lobby which writes legislation for them to adopt and is funded to a large extent by the private prison industry. The taxpayers are suckers for not throwing these people and these laws out. They are also responsible for the 'model' immigration laws for Arizona and Alabama designed to create a need for more jail space and guards. I would be interested to see how the costs to these states have gone up when these laws were enforced. I hope someone is keeping track.
