It's generally pretty easy to get a witness like this really angry during cross-examination.

'Course, people who lose their temper start making mistakes. And there are all kinds of physical things happening in your body when you really get angry - muscles tense, blood flows change, and anger is quite painful. Your head hurts.

If t'were I, my strategy in cross-examination would be to needle him to death explosion. Hopefully a really big explosion.

Let's allow the jury to see the full character of Robert Costello.

They talked about the first witness when they were called on the stand a previous day. They work for the law firm repping Trump, and presented some details on some documents. Nothing of any import.

The first defense witness testified very briefly yesterday (Monday) before Costello was called. He was a custodial witness, paralegal Daniel Sitko, testifying about phone records used to construct a chart showing calls between Costello and Cohen. The Times' live blog for Monday did have some notes about it. It was kind of eclipsed by the fireworks with Costello.

I think D.A. Bragg's decision not to vigorously cross-examine Costello is a missed opportunity, but I admit it's a judgment call, and they may be trying to get it over with. It sure sounds like Costello's testimony is worthless for the defense in any case.

But now we get a whole week off from any activity in this case. And the jury gets a whole week to just think about things, before they come back to work. Again, I am so jealous.

Next Tuesday, the judge will try to fit in all the final arguments plus giving his jury instructions on the open record, all in a single day (hopefully a little less, giving the jury time to get started before going home for the night). Then they'll have three full days for deliberation next week.

I'm gonna try to stay hopeful, but I remember the verdicts after Malheur and Bundy Ranch, so I know that juries do crazy things sometimes.

Prosecutors and Trump’s Lawyers Will Jockey for an Edge With Jurors

The two sides are expected to lay out their dueling visions for how the judge should instruct the jury as it prepares to weigh the charges against Mr. Trump — 34 felony counts of falsifying business records.

Jury instructions are typically meant to translate legal treatises into something intelligible to the 12 laypeople who will decide the case. The instructions provide jurors with a road map to help them apply the law to the facts they have gleaned from the witnesses, documents and other evidence that have been presented to them.

The New York Times has obtained early drafts of each side’s proposed jury instructions, which were filed with the court in recent days and will underpin their arguments to the judge, Juan M. Merchan. That conference will take place outside the presence of the jury.

BOVE: Next on my list is a proposed jury instruction about involvement of counsel, despite Merchan's pre-trial rulings that Trump himself could not argue that he was convinced of the lawfulness of his conduct because lawyers were involved/he relied on his lawyers.

MERCHAN: This is an issue that’s been going on for a very long time. Going back to I think it was December of '23, I’m not sure. The People filed a motion asking this court to require the defense to require and give notice whether defense was going to rely on advice of counsel. I wrote a decision on this on Feb 7 and I directed defense to provide disclosure by March 11, and to produce all discoverable statements and comms by same date. In response, the answer was we are not relying on advice of counsel. Later on, defense advice of counsel morphed into something called presence of counsel, which I had never heard of, not familiar with, but addressed it in a motion in limine.

MERCHAN: I ordered that you were precluded from arguing this legal claim. There was no such thing. Just a way to get around having to turn over docs.

MERCHAN: Now it’s morphed into involvement of counsel. I understand why you want this instruction from the court. But my answer hasn't changed and I find it disingenuous.

MERCHAN: It was concerning when the terms changed to "presence of counsel." I couldn't believe when i saw it again now calling it "involvement of counsel."

MERCHAN: My ruling is the jury will not hear that instruction from the bench nor are you permitted to make that argument. Period.
