Court order. That would be a court enforced order to have material removed. We have been trying to get one in Liberi, et al v. Taitz, et al. That was the last motion in the 3rd Circuit we lost. As for the 'court order' part, I consider that one of the less nice suggestions you posted in this thread. It could be construed as threatening a member of this forum.

IANAL and can only comment from my non-US pov on this your point:
you fail to see that PJ and now TFB is a forum and not the opinion of one single person (unlike Orlys blog and moderated comments). You will find here original opinions of many people that are not removable due to the 1st Ammendment. And where quotes were made using any of the many birfer websites, the quotes are well within the fair use clause of the copyright law. A court order will have to list each and any post you wish to have removed. There will be no blanket type of order that will make the forum owner liable to remove what you think may be a wrong statement. So please, start your work real soooon now, you have two years worth of posts to scan for said court order.

Or did I miss something ? Did you only want your pending slot in the gallery removed ? Now that would have been a failure too, as nobody can be identified by showing nothing about them.

Let's get back to business as usual on Fogbow, please, and discuss birtherism in general and not try to solve inner-birther personal issues here. Thanks.

So now let me voice my personal opinion on the events of this last day:

I don't know what happened to Doc that he came ranting about the Birther Gallery. I know that some of Orlys Flying Monkeys searched the web for associations and revealed some of Docs other aliases and blogs. I guess he may have also received some nastygrams from that quarters. I don't think that the gallery here at TFB was the initial point for the research, just that the monkey squad has little else to do since all law suits to date have been put to rest. RIP.

It's my opinion that the gallery ought to remain. It's nice to put faces to the different aliases on the web. All pictures were 'harvested' from public sources, or from images taken at public events. Any birther has implicitely agreed to show their face while pursuing their cause.

I surely would oppose if any further identifying information were to be added, eg no real life names, addresses, phone numbers etc. If anyone is interested in such stuff, they can research themselves.

As for the term 'mugshot', imo it's a colloquial for a portrait photo. Birthers, feel free to supply your own and put yourself in a better light ! Not to forget the few real mugshots that were aquired by harvesting real mugshots of harvested persons.

Re Calpernia and her 'threat': I think she is walking a tightrope, but she is a long time member I agree to give her the benefit of doubt for now.

I do not think you could ever be a mushroom. I think you are more like a rose (wish I knew how tp put a picture in) without thorns and that you only use the ones with thorns when you have to put us back in line so things run smoothly.

You do a good job with the forum, you try to be fair to everyone and I don't know how you do it, with your business and family, but you manage to do it and not negelect any of the priorities in your life. To me that is an amazing feat.

No, but I've been to a mushroom "factory" in Tennessee that produced 500,000 lbs. of mushrooms every month.

Dat's a lotta mushrooms. They were in 47 growing rooms. I was doing tech support for the hardware/software system they used to keep track of how much to pay the harvesters. They get paid more for the little ones, because it takes more time, pickin' them li'l buttons. And I learned how they treat the mushrooms: They keep them in the dark and feed them horseshit. I no longer follow the Obama eligibility cause and haven't since November 2009. But I wouldn't dream of saying that all birfers are terrorist (even though Calpernia appears to believe that we obots have no ability to think critically about the issue). Even when you were following the birfer movement, you never struck me as someone who advocated for sedition or for violent rebellion. I never felt like you were a threat, and I don't think others did either.

I really don't want to ban CalperniaUSA. She's a longtime member and has always obeyed the rules. She DID have a legitimate beef with us posting the placeholder and saying a photo of her was "needed".

Did y'all see that? I deleted it, but it DID say a photo of her was "needed". Hell, I'd have been PISSED at that myself.

I'm embarrassed that I didn't see that months ago. I apologize for it, though again, I don't know why the hell she didn't just tell me about it before. She and I have always treated each other fairly, and I would have taken it down long ago, if she had just told me about it.

She recently volunteered to help us with affidavits if Anthony Martin sued Justin. OK? She took down the Butterfly Lady's personal info off her site when I requested it. This is not a bad lady. Y'all have backed her into a corner. She said if the photo doesn't stay down, she'll try for the court order. To me, that means if the photo does stay down, which it will, then there's no more threat of court action. But y'all are trying so hard to get her banned, she's got her back up.

I'm the same as the rest of you. I'm not afraid of any court action. I didn't act because I'm afraid of her or any lawyer in this great nation. I took it down because it was the right thing to do, and we're not putting it back up because that's the right thing to do.

Calpernia, I wish you'd make a public statement that if it stays down, which it will, then you're not going to bother with court action. Please PM me, too. I'm not your enemy.

If the threat of a lawsuit against us is still present, I might reconsider. For now, I'm giving her a pass on the threat. In a way, it took some courage to make the threat, since she just saw maxbond zapped yesterday. But she had a legitimate complaint, she just should have handled it a different way. If she had handled it right, nobody but her, me, and verbalobe would have known (OK, and listeme). If I'm reading her posts right, she's withdrawn the threat. Just 2 a few points, Foghorn.

1. Sometimes folks make comments because they haven't gotten to the end of the thread. We all do it. Even you. Then we realize, oh, look at that, and edit our comment (often not always). We aren't trying to continue stirring the pot. This is a weakness in any forum setting. It is the nature of forums.

2. How is pointing out that a member has violated a forum rule "trying so hard to get her banned"? Now, I don't know if you have received PMs or something that support such a comment; I wouldn't be surprised if you had. After all, there is a little red triangle that is to be pressed when a board violation has occurred. But I don't see anyone "trying" to get anyone banned. Stating one's opinion isn't trying to "get her banned".

I am responsible for my words. Lisa O is responsible for hers. If she wants to play the threat game based on comments she doesn't like, then HER THREATS need to be evaluated. If she has a problem with something I have said, she can address me. She can address anyone about any of their posts. I don't see how that justifies continued threats against the site (even when her everything was removed). What you chose to do about it is your business. Now that I read your post, I shall go edit some of my previous posts.

3. Please don't hold board members responsible for knowledge that they had no way to access. It is fantastic that Lisa O offered help to you and Justin. There is no way for any of us to know that unless it is shared with us. Again, good for Lisa O. That was a stand-up offer. But members can only act/comment on what they know. For 99% of us, that is limited to what we read in public.

4. Alerting a mod regarding a forum violation doesn't mean that we are plotting against a member or "trying so hard to get her banned". I thought of pressing on the little triangle and decided to wait until I read the rest of the thread. Had I been posting WHILE this was occurring, I would have likely PMed one of the mods or you. I wouldn't demand anything. Instead, I would desire to WARN you of something that was posted that MIGHT warrant your attention. My intentions would be to protect you and the site by bringing an issue to your awareness. That is it.

Ya know what? I think that we all do a damn good job of doing our best and working with good intentions. Comments may get hot, but that doesn't mean we intend someone ill.
