How did Hannity stumble into Cohen? Was Cohen recommended by Trump, or did Hannity hear that if he consulted Cohen he might just bump into Trump at Cohen's office?

If Cohen's only client was Trump (ignoring Hannity's $10), then whose money was used to pay off Stormy -- it seems that Trump would be Cohen's one and only source of that kind of money.



Arguably Cohen is still "practicing law" even if he had only one client, but with only one client - and that one under serious investigation - it's hard to assert that any of Cohen's records or files are completely unrelated to the investigation. And it's hard to assert that Cohen was practicing law if he were not doing any of the things that are permitted only to lawyers (e.g., representing people in court, privilege communications with clients in jail; oddly enough, litigation over unauthorized practice since Norman Dacey published How To Avoid Probate has much reduced what is limited only to lawyers).

After some thought, I think I've identified what's being misinterpreted.

The feds told the judge, as they also did on Friday, that any materials identified as either privileged or potentially subject to an exception to privilege (such as crime-fraud) will be shown to the counsel for the privilege holder. And, if the privilege holder disagrees with the exception, the matter will then go to a magistrate. (That's their proposed procedure if there's no special master.)

After an afternoon of pitched arguments over who should have the right to vet documents seized from President Donald Trump’s personal attorney, a federal judge in New York delayed a decision on whether to appoint an impartial “special master” to conduct the review.

U.S. District Judge Kimba Wood said that federal authorities who seized documents from the lawyer, Michael Cohen, would provide copies to Cohen’s team. A lawyer for Cohen said they could provide a list of proposed special masters by Tuesday. The government will also provide names.

The judge voiced confidence in federal prosecutors and stressed that she didn’t want to slow down the matter. “I have faith in the Southern District U.S. attorney’s office that their integrity is unimpeachable,” Wood said. She said her interest is in “getting this moving”speedily and efficiently.

Prosecutors will consult with the filter team and the FBI to get a better estimate of the volume of records. They will supply Wood by early Wednesday with an estimate of how long it will take to get the records to Cohen’s attorneys. Lawyers for both sides will then confer about proposed electronic search terms for the documents.

Fox News anchor Shepard Smith described Sean Hannity being the third client of Michael Cohen, President Trump’s personal attorney, as the “elephant in the room” during his Monday afternoon program.

Smith is the first Fox News anchor to mention the link on air.

“Of course, for us, the elephant in the room is that Sean Hannity is said, according to court documents, to have been a third client of Michael Cohen,” Smith told viewers. “There’s a statement at The Hollywood Reporter supposedly from Hannity that says, ‘We’ve been friends a long time. Attorney and frequent Fox News guest Alan Dershowitz criticized host Sean Hannity on Monday for not disclosing his relationship with Michael Cohen, President Trump's attorney, during his frequent discussions about Cohen in recent weeks.

Dershowitz, a defender of Trump amid his legal woes, was brought on to discuss former FBI Director James Comey’s Sunday night interview on ABC News, but first addressed the Monday revelation that Hannity is the previously unnamed client of Cohen.

“I really think you should have disclosed your relationship with Cohen,” Dershowitz said, calling it a “complicated situation.”

“It was minimal,” Hannity responded.

“I understand that, and you should’ve said that,” Dershowitz, an opinion contributor for The Hill, replied. You were in a tough position because, A, you had to talk about Cohen, and, B, you didn’t want the fact hat you had spoken with him to be revealed.”

“I have the right to privacy,” Hannity interjected. “It was such a minor relationship.”

“You should have said that,” Dershowitz said.

Two Democratic lawmakers on Monday called on Fox News to take Hannity off the air over the undisclosed relationship, saying Hannity covering the Cohen story represents a conflict of interest.

Hannity downplayed his connection to Cohen shortly after the news broke, asserting that Cohen had never formally represented him in legal proceedings.

“I have occasionally had brief discussions with him about legal questions about which I wanted his input and perspective,” Hannity tweeted, adding that those conversations “dealt almost exclusively about real estate."

Dem lawmaker calls on Fox News to fire Hannity

Rep. Gerry Connolly (D-Va.) said Monday that Fox News should fire Sean Hannity following the revelation that he is a client of President Trump’s personal attorney, Michael Cohen.

Hannity has frequently covered stories about Cohen — including the FBI raids on the New York lawyer's home, hotel room and office last week — without revealing his own connection.

“I think he is so into this like a pig in the mud he can’t get out of it. And I think he deserves to be fired. His word can never again be trusted,” Connolly said on CNN.
Connolly said Hannity’s involvement with Cohen represents a conflict of interest, calling it “a big stain on Hannity and Fox News.”

He also hit Hannity for spreading conspiracy theories about former President Obama, former Secretary of State Hillary Clinton and slain Democratic National Committee staffer Seth Rich.
