Orly's all excited again.

Great news! We made the deadline in IN! The deadline was 12am, we got time stamped papers at 10:51

We needed to make the deadline with our candidate complaint in Indiana. The deadline of 12 am local time was looking. An original challenge against candidate Barack Obama was filed with the election commission by a registered voter at 10:51 am. We need your help in alerting media. They wrote a lot about the Secretary of State Republican Charlie White being thrown out of office. Now we need to hound all of the same media outlets and demand coverage of this complaint against Obama. We need the same District Attorney, who filed charges against the Sec of State in Marion county, IN, to file criminal charges of elections fraud, wire fraud, Social Security fraud, uttering of forged documents, against candidate Barack Hussein Obama. I need all of you to help me make that happen

BTW there is a meeting of the IN Election Commission next Friday - perhaps Orly should buy her tickets now

So does a challenge require a hearing, or can someone in Ind. read it and say, this is crap, no hearing for you?

Maybe someone in Indiana will remember that there is a case on point and flush this where it belongs.

IANAL but I don't see any compulsion to hold a hearing in the Indiana Code.

This is O'rly in her role as prosecutor. The ballot challenge is secondary. She admits the two-citizen theory is a loser. The winner for her is to get somebody, anybody to arrest Obama for fraud and forgery based on her 'evidence.' How can they prosecute White and not prosecute a bigger crime?

It's all about the smear and getting publicity for it.

There's a lot of fail in this sentence. The former Marion County prosecutor involved in the case was White's defense attorney. White was prosecuted in Hamilton County, not Marion County. The prosecutor was a special prosecutor, not the county district attorney.

But –

Why won’t, this challenge, be dismissed under Ankeny v. Governor of Indiana? How is it different?

Your social security and identity “fraud” claims have nothing, to do with, eligibility.

So, I don’t see, how you have a chance of prevailing.

Can you esplain it to those, of us who aren’t, lawyers like you?

Taitz wrote:
they have everything to do with eligibility, as Obama has no valid identification papers to show him being born in the country. a person, who is born in the country has a valid birth certificate and a valid SSN ID. He does not need to resort to posting a computer generated forgery on line and using a stolen SSN of someone born in 1890 in another state. Don’t tell me, you are so brain dead not to understand this. Even obots like you understand the point

Insight wrote:
As far as I can tell, the eligibility clause doesn’t require “identification papers.” Indeed, American citizens, don’t carry “identification papers” and attempts, to creat5e a national ID have been rejected, as contrary to our values.

Your case is a loser on this issue. And based on Ankeny it’s a loser on the two parent issue.

Actually, it's entirely possible that she does not. IIRC, she attempted to schedule at least 1 Georgia deposition for 12 am.

But IIRC, the statute says "Noon." They must have anticipated her.

Offtopic :
<nitpicking geek>Actually, there is no "12 am"*--the deadline was 12 noon--"am" refers to anytime before noon and "pm" refers to any time after. Noon is the border between them.

* Although most people (as you imply) consider 12 am to be midnight, not noon.

Do we have any word on whether this challenge will be heard on Friday? Oily said it might be bumped to Monday.

The agenda's not up on the website yet and with today being Presidents Day I don't expect we'll see it until tomorrow or even Wednesday but I check every now and then.

I spoke too soon, some one must be working in Indiana today:-

Election Commission Agenda.

Includes 4 challenges to the President, 1 to the Newt and 29(!) to the frothy one. (Also 2 to Sandifer, but that s/b a slam dunk as I understand that she hasn't even file a petition)

To answer BFB, it is Karl Swihart who is "Orly's stooge". From her filing:

7. Please, find attached a sworn declaration for representation of a citizen of Indiana, Mr. Swihart, who prepared form CAN-1 and submitted it to the Elections Board and requested for me to represent his ballot challenge before this committee.

Additionally, I am demanding the elections board to rule on my Election fraud complaint, as well as
complaints of other citizens, who were directed to e-mail their complaints and fill out election fraud
complaints

The challenge to the Frothmeister appears to be on the basis that he fell 8 petition signatures short in District 7, in Marion County.

Indiana voters want Rick Santorum off ballot

Quote:
To be on Indiana’s ballot, Republican and Democratic presidential candidates, as well as candidates running statewide, must collect the signatures of at least 500 voters in each of the nine congressional districts. While Santorum’s campaign said it collected more than the needed number in each district, Marion County voter registration officials say he fell eight short in the 7th District, which is entirely in Marion County.

On Monday, four voters — Jerry Bickle of Columbia City, Philip A. Smith of Indianapolis, Reynaldo M. Farias of Noblesville and Christopher C. Watson of West Lafayette — each filed challenges with the Indiana Election Division saying Santorum did not meet the state’s ballot requirements and should not be on the May 8 ballot.

Watson, a graduate student in mechanical engineering at Purdue University and a Republican, said he filed the challenge because if no one objected, Santorum would be on the ballot.

“I’m a big believer in playing by the rules,” Watson said.

I have to agree. What business do these Repigs even have pretending to be fit to be President when they can't even do their nomination papers correctly?
