I was so hoping for a Fielding Mellish moment when Taitz tried to take the stand. Watching her cross-examine herself (and get frustrated as she was getting the wrong answers) would have been one of the highlights of birtherism. Too bad Judge Malihi didn't let it take place.

The Presidents SSN was issued in 1890 (looking good Mr President)

More wild ass speculation. Malihi is a Fogbow lurker and wanted to see for himself if O'rly is as really as batshit crazy as she has been portrayed. His court deals with pedestrian matters day in and day out. It was a chance of a life time to have a classic performance by Lady Liberty. History was made today. Comic history if not constitutional.

There are two mentions on Drudge buried under an avalanche of anti-Newt headlines with one link to White House Dossier and one to the AJC article summed up the event.

http://www.ajc.com/news/georgia-politic ... 18374.html

This was the main blurb included in the AJC

Quote:
Lawyers for area residents mounting "birther" challenges told Deputy Chief Judge Michael Malihi that Obama should be found in contempt of court for not appearing when under subpoena to do so. But Malihi did not indicate he would recommend that and cut off one lawyer when he criticized Obama for not attending the hearing.

"It shows not just a contempt for this court, but contempt for the judicial branch," lawyer Van Irion told Malihi.

"I'm not interested in commentary on that, counselor," Malihi quickly replied.

Lawyers and court watchers, have you ever before seen a lawyer call on self to testify, take an oath and sit in the witness box and just keep going with the the steam of effluent. Jaws must have dropped all over. Even birthers must realize the novelty of this performance.

As a matter of fact, yes. Once. My father did that. He was representing a client in a small town justice of the peace court on a traffic matter. The police officer testified about the Vascar equipment he used to clock the defendant's speed. Dad got the officer to claim he was an expert on the radar equipment. As an "expert" the officer testified that the beam emitted from the Vascar device was cigar shaped. WTF? Radar is a conical beam.

So my dad, who was a Tennessee Highway Patrol officer for ten years before going to law school, asked the court to allow him to take the stand and testify. The JP -- I don't recall whether he had a law degree or not -- swore Dad in and Dad took the stand. He qualified himself as an expert witness on the use of Vascar devices.

His client was acquitted.

Just like something out of "My Cousin Vinny."

Didn't happen at any point of the hearing that I could manage to hear.

Yeah, the sound was so bad (and Orly's hard to understand anyway), I didn't hear anything at all about the Great NO-SHOW! Not a peep. (If I'm wrong about this, please someone correct me!)

I have a suspicion that the LHDCALJ must have put the kibosh on any theatrics directed at the President or his absent counsel during the pre-hearing conference in chambers. Otherwise, I'm all but certain that Orly had a whole string of invective ready for spewing on that topic.

Did the birthers also establish the President's residency during their brilliant presentations?

No, but I believe that point was conceded in their moving papers.

Orly put herself on the stand? She is completely no-holds-barred-grade-A-batshit-insane. The transcript should make interesting reading.

Was there a SECR at this hearing? It occured to me that administrative hearings may not have court reporters present. If there was one working this hearing, he or she deserves hazard pay and a good stiff drink!

I didn't notice that he was posting in the comments.

More from Jay:

Quote:
Attorneys for two previous plaintiffs argued the “natural citizenship” angle, introducing Obama’s books as evidence that his father was not a citizen. The theory is that you cannot be a natural-born citizen unless you were born here and BOTH parents were citizens.

One of the attorneys was state Rep. Mark Hatfield, Republican from Waycross. He asked the judge tobuild Obama and his attorneys in contempt for refusing to appear. Another attorney accused Obama of contempt “not just for this court but for the whole judicial branch.”

The judge cut short that rant.

Judging from his body language, Malihi is not happy to be here. But maybe that’s just me.

later:

Quote:
Her current witness is laying out the grounds upon which Barack Obama could be arrested and deported for falsely claiming US citizenship.

then:

Quote:
Excellent. The judge asked Taitz to give her closing argument. In the middle of doing so, she decided to turn into her own witness and sat in the witness chair to give testimony

The judge finally stopped her.

I can't wait to read his column.

We are now being treated to “expert” testimony and “evidence” that the Hawaii birth certificate is a fraud.

Surreal.

Minor v. Happersett is a SCOTUS opinion about states rights as it pertains to the privileges and immunities clause of the Constitution. The SCOTUS opinion mentions in dicta, or conversation about the case, a native born with two citizen parents is undoubtedly a Natural-born citizen. It also states there are other scenarios where a person would be considered a Natural-born citizen, but the Court chose not to address the specific issues.

The Judge refused to enter Obama’s Indonesian school record, while allowing Plaintiffs to enter copies of Obama’s COLB and long form BC as authenticated and certified documents of his birth record.

Anyone who thinks Judge Malihi will rule Obama is not qualified based on this is kidding themselves. It’s a set up.
