Some of you have met Bmaz, a blogger and defense attorney who lives in Phoenix. He is on this like an angry bird on a pig. He personally knew one person who died in sheriff Joe's custody man years ago. This has got to stop.

I will personally punch out the first birther who makes this incident about Obama.

Bmaz hasn't written about this yet. He may, at Emptywheels. I'll tote some of it over if he does.

The injuries obviously occurred while Atencio was at the jail; his booking photo shows him to be quite unharmed.

The DOJ Letter on Arpaio Investigation.

Is it just me, or does Arpaio appear completely surprised that the gubermint would dare to go this far and take such actions against him? He really is the bully who is shocked that those in power would dare to tell him to stop his egregious behavior.

That neo-Nazi thug has been allowed to act in a completely lawless manner for so long that I imagine he actually is completely surprised anyone is even criticizing him. It's way overdue that they take out the trash. If there were any justice, that worthless excuse for a human being would spend his remaining years behind bars.

As a poster boy for the tea party and the sovereign citizen movement, it appears Joe believes he runs a completely sovereign organization.

This isn't his first time at the federal rodeo. He's been investigated many times, but always skated thus far. He's brunt toast now, though. Mr. Atencio will not have died in vain.

Cf. P&E: Update: Letter Asks Tennessee Governor if He is Corrupt
Quote:
AND WHAT WILL HIS ANSWER BE?
David Briggs (to Governor Haslam) wrote:
It is my understanding that Walter Francis Fitzpatrick III is being held in a cold solitary confinement cell in the Monroe County, Tennessee jail. I also understand that he is being deprived of the medicine needed to control his diabetes.

Could this be true?? In the 21st century, in the United States of America?? If it IS true… if a corrupt sheriff in Monroe County, Tennessee, the state that YOU govern… is literally torturing a highly decorated, retired officer in the United States Navy, then you’re as responsible as is the sheriff!!

[...]

Another citizen letter reads:
Quote:
Walter Francis Fitzpatrick III is being held in a cold solitary confinement cell in the Monroe County, Tennessee jail.
The conditions described in this jail remind me of prison camps in Poland in World War II. Has our nation become a banana republic? IS THIS the return of the WILD WEST and a SHERIFF WHO CERTAINLY APPEARS TO HAVE NO REGARD FOR THOSE BEING HELD IN THIS PRISON. If Commander Fitzpatrick dies from cold and exposure, TENNESSEE ELECTED OFFICIALS HAVE ALLOWED THIS TO HAPPEN. Inaction is action . You need to see what is going on in the Monroe County jail system. What a Merry Chirstmas message you are sending around the coutnry if this Commander dies in prison.

Birthers applaud Arpaio for maltreating his wards, but are outraged by the poor treatment of one of their own.

I wonder if he has ordered his EagerBeaver/HoverRound scooter yet?

Hello, it is approx. 12:33pm, I just got a call from a friend at Occupy Phoenix. Very sad to report but sometime today the family of the veteran killed by sheriffs deputies will dicontinue life support. At this point our Occupy Phx. brothers and sisters will be there at 3:00PM. If this soul passes away before then, we will meet and hold vigil in front of the 4th gulag/jail. Shame on Joe Arpaio and his human rights abuses ! We are the 99% !Leonard Clark

Joe Arpaio and MCSO "Murdered" Ernest "Marty" Atencio, Says Family
By Stephen Lemons Sun., Dec. 18 2011 at 11:34 AM

He described his brother as being "viciously" Tasered by jail staff, causing Marty Atencio's heart attack and subsequent death.

"They did it so brutally that they put him into cardiac arrest," an angered Mike Atencio related. "And then they threw him in a cell. So after they killed him, they threw him in a cell to sit."

This contradicts the MCSO's slithery semantics from Friday, where the agency claimed Marty Atencio not die in MCSO custody.

"What's keeping him alive is the hospital function and the life support," Mike Atencio told me. "Without the life support he would die instantly because he was dead before it even started."

Atencio said he was not sure if the family will have to make the ultimate decision to remove him from that life support today.

When murder charges come from this, I hope the County does not provide legal defense for Sheriff Joe and those he controls.

I expect they will.

The county will also be providing a defense (if there is one) to fight the fed charges recently put forth if there's need for a defense. All this in addition to the countless dollars he's cost Maricopa County. Perhaps the recall will be successful and he'll be removed prior to this expense being necessary, but I won't hold my breath.

Rick Perry defends embattled Sheriff Arpaio

Quote:
By JORDAN FABIAN
Channel: Politics

Republican presidential candidate Rick Perry is standing behind embattled Maricopa County Sheriff Joe Arpaio, who’s been accused by the Justice Department of committing a litany of civil rights violations against Latinos.

Perry, the Texas governor who received Arpaio’s endorsement, suggested that the Obama administration is guilty of carrying out a political smear campaign against the sheriff and attacked the president’s record on border security.

I don’t know what all the details are ;) , but I do know this: nothing surprises me out of this administration. This administration oversaw ‘Fast and Furious,’” Perry said during an interview with Fox News on Thursday. ”I would suggest to you that these people are out after Sheriff Joe. He is tough.”

I doubt murder charges will result, and am somewhat concerned that a choice to discontinue life support makes such charges problematic. Sheriff Joe has been killing prisoners for a long time without criminal prosecution.

Steve King is also defending Joe.

Quote:
Congressman Steve King (R-Iowa) is vice chairman of the House Immigration Subcommittee on Immigration Policy and Enforcement. He agrees with Arpaio's assessment of the Justice Department's actions.

"He takes great pains to make sure that he doesn't discriminate against people based on race," King asserts. "There is not a profiling operation going on down there that I can see, but I can see that this administration has a political agenda that's working against a man who stands up for the law. I defend Joe Arpaio; I think he needs to continue with the tent city."

Sheriff Joe has taken some lessons from Obly.

Quote:
Arizona Sheriff Joe Arpaio, who was accused by the Justice Department of presiding over a culture of anti-Latino discrimination in the Maricopa County Sheriff's Office last week, offers his take on what violating someone's civil rights looks like:

Likewise, the sheriff denied unlawfully targeting critics for arrest during political protests. "We don't go after anybody," he said. "Actually, they go after me. They're demonstrating in front of my building, calling me every kind of name. If you want to talk about civil-rights violations, what about that?"

Has a statement more symbolic of runaway right-wing victimhood ever been uttered? It's all there, the lack of empathy, the narrative of persecution, the ludicrous sense of self-pity, even the comically distorted understanding of the law. Naturally, the statement also actually helps confirm what Arpaio's critics are accusing him of—any sheriff thin skinned-enough to think it's illegal to call him a name is probably also enough of a megalomaniac to arrest people for criticizing him.

UPDATE 4:29 PM: Atencio's brother Mike just called to tell me that Marty is still on life support, and that the family has retained the services of Phoenix attorney Mike Manning, a well-known and very successful legal foe of Sheriff Joe Arpaio.

Official comment by the Phoenix Police Dept regarding their arrest of Antencio (same link):

Quote:
snip.....

On Thursday, December 15, 2011, just after 9 p.m., Phoenix Police officers were dispatched to the area of 2800 West Laurel Lane in Phoenix regarding a suspicious person. The caller, a resident of the area, advised our dispatcher a male individual was kicking at an apartment door at their complex. The victim caller also advised when she turned to call police, this individual followed her and confronted her in an aggressive manner. The victim caller believed she was in danger of being assaulted by this individual based on his actions however, the male suspect became distracted by a passing vehicle and began chasing it.

Officers arrived on scene and after speaking with the victim, arrested the male suspect who was identified as Ernest Atencio, a Hispanic male in his mid-forties. Ernest was transported by officers to the Phoenix Police Department's Jail Intake Center where he was processed to be booked into jail for assault.

After paperwork was completed and Mr. Atencio was processed, he was taken by Central Intake officers to the MCSO jail. We understand Mr. Atencio struggled with officers while going through the process at the MCSO facility. To date, we have not been provided with specific details as to our officers actions during this struggle, in part because we have not been provided any video of this struggle by MCSO.

We anticipate obtaining further information once MCSO completes their investigation. We understand, preliminarily, our officers did not tase this individual. Though we have not completed our investigation, we have no information at this time Mr. Atencio struggled with any of our officers prior to getting to the MCSO jail. We also understand, once MCSO staff took custody of Mr. Atencio and placed him in a safe cell, our officers had no further involvement or contact with him.

snip.....

Resnik tracked down Maricopa County Sheriff Joe Arpaio at the Christmas party for the MCSO's MASH Unit to ask him how more than 400 sex-crime investigations were botched on his watch.

The sheriff responded by working himself into a huff -- grumbling that the problem was solved in 2007 -- and then holding a puppy up to the camera.
If this pup happens to be in need of a name, "Smoke" or "Mirrors" each have a nice ring to them.

It's a shame that Arpaio has continued to flat-out deny that there's a problem, when the facts of the MCSO situation show clearly that things have been spiraling out of control for years. That progression is still happening, and getting worse, and we're going to continue to see tragedy after tragedy until Arpaio is stopped and the office restructured.

The do-nothing Maricopa County Board of Supervisors would be wise to reconsider how a sheriff is brought to office, and how he/she leaves. Term limits?

Arpaio is a blight on democracy, and he should be in prison (general population).

I’m sure that would have depended on whether or not the mother was barking with a Spanish accent.
