I've got two questions for fellow Fogbowers here, especially those who are lawyers.

1. If this case rules in favour of the plaintiffs and Arpaio's department receives an injunction, what impact would this make? Would it hinder alot of what his department had become accustomed to doing? Would it seriously impact on his plans to ignore the supreme courts modifications to the Arizona bill? Would it be a "big" deal? I've seen too many cases rule in favour of the plaintiffs, but the end result amounts to nothing....

2. How long would a case like this typically take before a ruling? Is it likely we'll receive the ruling of this case by the end of the year?

If anybody can answer these 2 questions for me, would be greatly appreciated. -xx

The case that is being tried right now is not the government case, but a private lawsuit. The plaintiffs are seeking injunctive and declaratory relief, but not money damages -- thus they would not have the option for a jury trial. So where are his letters of complaint to the book's editor? Did he write up staffers for infractions, send them off for some sensitivity training to reduce MCSO liabilities? Does he have a paper trail to support these claims? NO.

It seems pretty clear that the Sheriff was extremely proud of those most racist, hateful parts of his book..until now. And I'll betcha dollars to donuts that staffers who acted on citizen complaints about people spekin espanole and cooking tamales got fast promotions. Just my opinion.

This whole thing is just too much fun to watch...Ol' Joe just digging himself deeper into a shit hole. Hopefully the people who have elected him over and over will see what a lying bag of fetid wind he is. But then, reading the comments below The Ray Stern article suggests that he does have a devoted fan following. :-k

MCSO will be calling the head of CIS to attack the credibility of the plaintiffs' statistics. I suppose it's even money that CIS will be using Numbers USA's data.

Steven A. Camarota is Director of Research for the Center for Immigration Studies. Is he on the stand as an expert witness? In what field? His doctorate is in public policy analysis. This gives him no special expertise on the statistics of law enforcement, such as on whether MCSO disproportionately stops brown drivers. CIS is noteworthy for its anti-immigration stance; is he supposed to be an impartial witness?

In the past, CIS has redefined what an undocumented immigrant actually is. They have long ago decided that so-called "anchor babies" are to be counted among the undocumented. The cross examination could be hilarious.

I certainly hope this subhuman neo-Nazi's open boasting that his sole motivation for harassing Hispanics is racial hatred comes back to him in his trial for just such lawbreaking. It's disgusting that open criminals like Arpaio are in any position of authority anywhere in an allegedly civilized country.

This story from the Phoenix New Times, which I picked up from Digby's blog, seems to belong here, even though the article doesn't indicate whether the Maricopa County Attorney's Office was assisted by the Sheriff in the atrocity.

A Woman Was Held in Jail Because Authorities Thought She Was Illegal

The story also highlights the importance of affording preclusive effect to state birth records, since many citizens have nothing else they can use to defend against an accusation of alienage.
