Nita Lowey, D-N.Y., this will delay "implementation of the Affordable Care Act. ... Without IT infrastructure to process enrollment and payments, verify eligibility and establish call centers, health insurance for millions of Americans would be delayed."

But the federal government is the largest employer in the country. So Grassley’s amendment means that the largest employer in the country is required to put some of its employees — the ones working for Congress — on the exchanges. But the exchanges don’t have any procedures for handling premium contributions for large employers.

That’s where the problem comes in. This was an offhand amendment that was supposed to be rejected. It’s not clear that the federal government has the authority to pay for congressional staffers on the exchanges, the way it pays for them now in the federal benefits program. That could lead to a lot of staffers quitting Congress because they can’t afford to shoulder 100 percent of their premiums. (There’s also a smaller issue related to how retiree benefits might be calculated. But I’m only willing to go so far into the weeds here.)


There's more. It sounds complicated. And it sounds like the result of a Congress pissing match. Sorry.

The Hotze clan are a bunch of losers. The Dr. was charged with DWI a few years back. Those charges somehow went away. At least one of the other brothers was a drunk too. But that doesn't stop them from running around telling others how to live their lives.

The Fifth Amendment argument is such a drop-dead loser that it deserves no attention.

The Origination Clause argument appears to have a little more merit, such as it is. However, the Congressional Research Service has done a report on that clause, in part on how the Supreme Court has handled cases raising it as a challenge. The long and short of it is that unless something is a tax in the strict technical sense, the Supreme Court is not going to invalidate a law on the basis that it's kind of sort of tax-ish.

The "money quote," at least for this case, is here:

Incidentally, the "Invisible Hand" that the pugs worship like a God and believe will fix everything with fairy magic, at least in theory relies on market transparency, so that competition can shake things out. You know, knowing things like prices in advance. Without those things, there is no "free market," even if you do assume that a magical hand nobody can see will just fix everything for you.

The big fear has been of sharply rising premiums as insurers are required to cover people with preexisting conditions. And the biggest test case was always going to be California.

Well, the preliminary numbers for CA are in — and they’re looking very good, with costs coming in below expectations. At this point, it looks as if this thing is indeed going to work.

And think about the political dynamics. Because the Supreme Court decided to let states opt out of the Medicaid expansion, some states — notably Texas — will have a pretty dysfunctional version of Obamacare in 2014, although even those systems will provide significant benefits to many people. Still, the whole political calculus was supposed to be that Republicans in red states could point to the horrors of Obamacare and ride them to political victory. Instead, it looks as if we’re going to see blue-state residents reaping the benefits of a functional health care system, while red-state residents are denied many of those benefits, for what looks like no better reason than mean-spirited spite — because what’s going on is, indeed, mean-spirited spite.

I got a fun email from WND yesterday titled "ObamaCare Just Killed Its Millionth Person". Tantalizin', yesno?

Well, it turns out it came from Floyd Brown's latest playtoy, Capitol Hill Daily. A letter signed by Martin Biancuzzo, who writes:

How about that? When my youngest turned 18 he had to go get a new driver's license. Guess what they offered to do? Yep, register with the Selective Service. Imagine making stuff easier for folks!

One of his friends declined the offer, thinking it wasn't required. The mom asked me about it, and I had to tell her the truth. Then the kid signed up.

from that first link, Rep. Thorpe of Flagstaff sent an email telling people to call those who supported Medicaid. He later apologized, but said it wasn't his fault cuz he told people to be polite.

And the guy who left the threatening messages left a phone number. Brophy McGhee said he sounded drunk.

I was guilty of a threadjack a while ago about Electronic Medical Records, EMRs, & vented several times about my own issues dealing with this change as a Nurse Practitioner. I spent a little time trying to find my posts just now but didn't find them so just want to comment here. My boss sent me a great AMA editorial that does an excellent job of expressing how we folks in the trenches feel. I am so disappointed that I can't seem to cut & paste the link here but it was a PDF & I'll just guess that my boss's AMA account limits links? My boss titled the email to us "A great review of EMRs by head of AMA" & it was just so succinct in expressing the concerns of us providers. I now wish I'd written down my favorite sentence but it went something like this, that nowadays 18 month olds can figure out how to use an ipad but medical professionals with 7-10 years of post-collegiate education are brought to their knees by their EMR system. That statement is SOO!! true. It gave stats on how, a few years ago, folks would recommend their EMR system to others, but that # is down now, about 39% I think. I would have loved to read the IT Fogbowers' comments about this AMA editorial . It's quite clear that the IT folks & the medical providers need to spend a LOT more time explaining exactly what it is that we do in a clinic.

Of course, we can only keep trying, but we waste so much time on the interface between technology & medicine, instead of spending that time on patient care. I will just expect it to get better. Meanwhile, my old 45-50 hour work week, is now a 55-60 hour week, because I am now "so lucky" that I can work from home. I am really proud of the 2 of my colleagues who have set firm limits & won't work from home. The rest of us are bleeding-heart-wimps. Will it burn us out? We'll just have to wait & see.

It's bad IT.

Hawaii has also turned all the agencies on aging into ADRC (Aging and Disability Resource Center), with very defective software. People who used to meet with older members of our society and and see what assistance they qualify for now must ask them 350 questions to enter into the database, plus anyone 18 and over with a qualifying disability. The questions are very personal and have nothing to do with qualifying for assistance. For example, sexual activity. Not kidding.

I also have major problems with Hawaii outsourcing Medicaid to for profit mainland companies. They are paid for their services plus bonuses for cutting costs (i.e. services). Lingle's pitch was that it would reduce costs, but it has not. It has killed a number of people, however. l received some documents about the abuses and bonuses and forwarded them to Abercrombie, for a big yawn in return. A whistleblower was threatened with arrest and reported for handcuffs in Honolulu, but the state backed down.

I've seen medical records recorded for good purposes in Australia. That country and others with universal healthcare recognize early the danger of some medications that the US does not. Personally, I support national collection as it prevents or ends dangerous practices and recognizes trends. Well, in a free society, anyway.
