Not that unusual, really. Often a defendant will spend two years or more in custody before trial or sentencing.

But 1) it always has to be done with the defendant's consent, so there are no appeal issues; and 2) you get "credit for time served" applied to your sentence, no matter how long it takes. He's building credits ...

In minor misdemeanor cases, a prosecutor will often offer "CTS" as a plea bargain. It means "plead guilty today, be sentenced to the amount of CTS you have, and you go home later that day (well, actually the jails often release people after the buses stop running late at night/early morning, so it's more hassle for the freed inmate).

Back-of-the-envelope estimates have Huff looking at 2-3 years. So he'll be doing time, regardless.

The only situation where delaying is a bad idea is if you think you have some winning issue on appeal, and will never have to serve.

Federal prosecutors and Huff's lawyer, Scott Green, spent a hearing Friday disputing that punishment. The law that led to his prosecution and conviction was passed in the 1960s in an attempt to squelch violent political action.

Violating the law carries a maximum sentence of five years, but so few people have been sentenced for such a crime that little case law exists to set a clear standard for sentencing.

This is the kind of keen journalism and analysis that sits behind the paywall at the Pee and Eee. The whole article is pretty funny, but two things stand out:

Edit: Over in the Walter Fitzpatrick thread, there's an interesting link to what looks to be the whole article. As near as I can decipher, the oh-so-terrible central allegation is that the bad guys (e.g., cops, gendarmerie, state cops, mothers of state cops, feds, sheriffs, wives of sheriffs, sekrit Obama agents, et al) went around showing this highly prejudicial video to practically everyone in Monroe County. As a result, the citizenry was really, really askeered and it poisoned the jury pool. Or sumpin' like that.

Now that I've read the rationale, it all makes sense.
