In a brilliant move, Orly accolyte Danny Alan Vestal filed the "COMPLAINT UNDER §19-3 ELECTIONS FRAUD" (that's Hawaii §19-3, mind you ](*,) ) in all 100 counties in North Carolina.

Birther ballot mangling is way too much fun to be legal!

Challenge to a Candidacy.

§ 163‑127.1. Definitions.

As used in this Article, the following terms mean:

(1) Board. – State Board of Elections.

(2) Candidate. – A person having filed a notice of candidacy under the appropriate statute for any elective office in this State.

(3) Challenger. – Any qualified voter registered in the same district as the office for which the candidate has filed or petitioned.

(4) Office. – The elected office for which the candidate has filed or petitioned. (2006‑155, s. 1; 2006‑259, s. 48(a).)

§ 163‑213.4. Nomination by State Board of Elections.

By the first Tuesday in February of the year preceding the North Carolina presidential preference primary, the chair of each political party shall submit to the State Board of Elections a list of its presidential candidates to be placed on the presidential preference primary ballot. The list must be comprised of candidates whose candidacy is generally advocated and recognized in the news media throughout the United States or in North Carolina, unless any such candidate executes and files with the chair of the political party an affidavit stating without qualification that the candidate is not and does not intend to become a candidate for nomination in the North Carolina Presidential Preference Primary Election. The State Board of Elections shall prepare and publish a list of the names of the presidential candidates submitted. The State Board of Elections shall convene in Raleigh on the first Tuesday in March preceding the presidential preference primary election. At the meeting required by this section, the State Board of Elections shall nominate as presidential primary candidates all candidates affiliated with a political party, recognized pursuant to the provisions of Article 9 of Chapter 163 of the General Statutes, who have been submitted to the State Board of Elections. Immediately upon completion of these requirements, the Board shall release to the news media all such nominees selected. Provided, however, nothing shall prohibit the partial selection of nominees prior to the meeting required by this section, if all provisions herein have been complied with.

I was hesistant to start a new thread on this when I saw Orly's poopie. I'm not sure that emailing 100 election officials with a completely irrelevant document constitutes filing an "election challenge".

I posted it because Pambly's Obama State Ballot Challenge 2012 has listed it as the North Carolina challenge. Orly and the rest of the birferin' community apparently believe this complaint is sufficient to set everything in motion. WND runs an article on it in 3 ... 2 ... 1 ... ("And now there are four!")

I have a friend or two in Wilkes -- but they are, sadly, Republicans; while thinking Orly is a loon as I am sure they must (both are, heavens, Pro-Choice and actually thinking individuals), they probably wouldn't want to take the time for what they see as helping BO.

Actually (if it ever comes to pass which I seriously doubt) I can cover Onslow, Carteret, Duplin, Jones and at a pinch Lenoir, Sampson, Pender, Craven, New Hanover. At my direction a certain person who I will not name but who is related to me by marriage ( :-* ) can cover Columbus, Brunswick, Bladen and Robeson.

Like I said, if it ever comes to pass, which I seriously doubt. There is no way Orly is gonna spend the flying monkey airmiles to fly to every county in NC. Not gonna happen.

If someone wishes to rely on 163-127.3, they should also take care to comply with .1 and .2.

Those 100 emails were not verified affidavits. There is no North Carolina challenge, IMO.

Well yes, it is very convenient that one state's law applies in every other. If the NH Supremes have jurisdiction, then certainly NC must.

Like I said, I know that this is going nowhere. I know that. BUT, in the wild offchance that it might, someone showing up in Onslow County before the Board of Elections and spouting the kind of stuff that Orly frequently spouts about our POTUS would not get a friendly reception. I have several attorney friends (male and female) who view the POTUS as their BFF. One particular female attorney here (my former boss) has been known to cut a bitch. Just saying.

Well, of course they do, but not for the reasons you state (or might think).

It's really very simple. It's not so much that one state's laws apply to every other in the sense they are state laws. This is a matter of a "federal" election. All federal statutes are the same, to be applied equally. Therefore, federal election = federal law which then flows downwards to the individual states. Since they can make no law that (for lack of a better term and for the ease of understanding of lurking birthers) "trumps" federal law, federal law obviously applies, and applies equally to all states. Simple really.

And you guys call yourselves lawyers... pffffffffft
