Van Irion sez, at LLF blawg

SIDE BAR

Quote:
Liberty Legal Foundation is going back on the offensive and filing for sanctions against the DNC's attorney. The DNC’s attempts to have me sanctioned in both the Arizona and Tennessee Certification Class Action lawsuits is a classic tactical move. When evil people are caught red handed, they accuse their accusers. They make up false allegations to discredit and delay those who would expose their evil deeds. This forces their accusers to abandon their efforts long enough to defend the false accusations made by the true evil-doers.

This tactic works every time, unless it’s punished severely. Even if the false allegations are proven to be false, the evil-doers get a break while their false allegations are addressed. By accusing me, the DNC forced Liberty Legal Foundation to take the time and effort to disprove all of the absurd accusations.

The only way to prevent this tactic is to punish those who use it. So, Liberty Legal Foundation has prepared a motion for sanctions against the DNC’s Tennessee attorney. We’re back on the offensive. Our motion points out that the DNC’s attorney filed documents with the Court that prove his own accusations to be lies. This means that the DNC's attorney knew he was lying to the Court when he did it, and we can prove it. (Read our proof in our response to the DNC motion for sanctions.)

Hopefully the Federal Judge in Tennessee will be as appalled by the DNC attorney’s behavior as we are and sanction them accordingly.

I suspect both the judges in AZ and TN are appalled, but not for the reasons Irion thinks.

It takes a certain level of chutzpah to file a motion for sanctions that is, itself, sanctionably frivolous.

I see PACER has gone up to ten cents per page. I hope folks are continuing to donate to The Fogbow for the acquisition of these documents.

"# 10 Exhibit Ex.8 Five Assumed Names" is a printout from the TN SoS website on that National Democratic Party of the USA, Inc.

Are there other zibits people are particularly interested in?

There is a nice ez way to contribute a set amount per month through Paypal. It just comes out every month. This method helps Foggy do a little bit of planning.

Actually, while I'm grateful for all the support, I don't get any of the contributions (except for the overwhelming support y'all gave me when I was hospitalized and unable to walk last October). All your money today, just like all the money before I got the GBS, goes toward "document acquisition," meaning pleadings from court files around the country, plus transcripts of selected hearings that we think will be most entertaining.

The Director of Document Acquisition gets the goodies and passes them to Jack Ryan, who puts them on Scribd and alerts realist. Very efficient system, we've never had any communication problems among them three. :-

The main source of those documents, of course, is PACER. That's where you can get anything on the docket in a federal case. However, as Sequoia32 mentioned above, the price of a copy of one page at PACER has risen from $.08 to $.10. Often, our Director of Document Acquisition includes hundreds of pages of exhibits, in order to give you a complete look at what was filed. That's helpful for others, too, because invariably someone will spot something in an exhibit (like an unredacted SSN or something) that's good info to pass along to the grownups.

The pleadings we've obtained over the years have been by turns hilarious, mind-bending, repulsive, and awesome. We've seen the worst legal writing in the world, and the best. They're a gold mine.

The transcripts, however, are far more expensive than the pleadings. Court reporters charge for the work they do, and in one or two cases we've been the only ones to order a transcript (the first, "original" transcript is a lot more expensive than ordering a copy), but if nobody else orders the first copy and the Director decides we need that transcript, he'll go ahead and get it for us.

Which is how he went thousands of dollars in the hole, providing the service he provides.

Yes, he lives to serve, and he has served us a plateful. I'll transfer your recent donations to him today.

Thanks again for your support. :-bd

Just a reminder... there is a hearing coming up Tuesday the 12th that could be a transcript candidate. Dunno... just sayin'.

I want to read it - I'll pop in an extra bit besides the monthlies.

Looking for someone to match a $25.00 donation to the cause.

Hmmm -- how about someone pointing out to dimmIron that he may himself be in trouble for propagating a class action law suit but not establishing his cause as such in court...

Found a wad of $3 notes in my safe deep below the ground in a secret Swiss bank safe. It's on the way to the FoggMaster.

06/18/2012 30 enMOTION for Leave to File Reply in Support of Motion for Sanctions and Motion for Leave to Exceed Page Limitation by Chip Forrester, Tennessee Democratic Party. (Attachments: # 1 Exhibit A - Defendants' Reply in Support of Motion for Sanctions)(Stranch, J.) (Entered: 06/18/2012)

Further, such an argument only goes to show how far Plaintiffs are willing to distort, misdirect, deceive, and suspend reality in pursuit of these frivolous claims. The Court should end this behavior by sanctioning it.

Quote:
The TNDP Defendants Correctly Described The Order Of Events In Arizona
As should be clear by now to the Court, Plaintiffs’ allegations of the TNDP Defendants’ “lies” are “lies” only in Orwellian sense when peace is war, love is hate, and truth is false. Yet, the Plaintiffs continued with this charade and claimed the TNDP misled the court as to the sequence of events in a similar case filed by Plaintiffs in Arizona.

Quote:
Notwithstanding this precedent and the facial absurdity of the position, Plaintiffs, and similar individuals, are nevertheless pursuing these baseless attacks against the sitting President of the Untied States in virtually every forum they can. It should stop, it must stop, but it won’t until and unless parties bringing these suits are sanctioned for the conduct of filing meritless, poorly researched, and groundless lawsuits.

:-bd

Quote:
If the Court had any doubt remaining, after reading the above, as to the bad faith of the Plaintiffs here, the Court should examine closely the allegations in footnote 2 where Plaintiffs raised the suspicion that because of “the history of Congressional abuse of the Post Office,” Defendant Wasserman Schultz committed a felony and conspired with the U.S. postal service to suppress the certified mail receipt from her served summons. ](*,) For the Plaintiffs, it seems a conspiracy is lurking behind every corner and these imagined conspiracies form the basis of the complaint now before this court.

Indeed! This entire pleading is a great read, and I highly recommend it to any of you interested in the issues in this case. There is a nice discussion of the notice provisions on Rule 11 sanctions. Kudos to Mr. Stranch!

My favorite:

That’s right, Plaintiffs justify giving the TNDP Defendants notice by serving a summons that did not identify the TNDP on a wholly separate entity located on the other side of the country.

Hoping no one would notice, of course. Slime.
