I assume he got advice from counsel on the issue before posting this. However, I do like that he adopts what I generally consider a good answer to the question "What is the law?" It is what happens when you go into court (with some degree of predictability). If that's not what happens when you go into court, it isn't the law.

When something is said to be "law," it ultimately comes down to whether guys with guns show up and enforce it, and whether people obey it.

If you go into court over and over all over the country and it never once comes down your way, you're just wrong. That's all there really is to it. A sane person, at that point, admits they're wrong, or at least reframes their argument as being their opinion of how things should be.

Almost all of the responses contained a mix and match of birfer claims as to why Obama is ineligible. One claims that an ambassador's child born here could be president. It's just to hard for the birfers to get all the rules and exceptions straight even when Fred breaks it down for them. He didn't get around to explaining how children of diplomats are treated differently under the 14th Amendment.

Actually, Obama always was and still is quite popular in Germany.

But it's not just the Americans with German roots who sometimes are quite reactionary. I have heard from colleagues from other countries that Americans who - at least partly - identify themselves with the home country of their ancestors tend to have ideas about the "old country" which are wildly out of date.

Birthers like to think that their questioning of Obama's eligibility is this huge underreported news story. And I think that we, in return, often forget what a truly peripheral issue it is to most of America.

Aaron Sorkin's HBO series "The Newsroom" depicts a fictional news program, and because it's set in the recent past, Sorkin is using the show to depict how big stories *should* have been covered. Episode 1 dealt with the April 2010 oil spill in the Gulf. Episode 3 spanned several months up until the 2010 midterm elections. Episode 4 dealt with the Gabby Giffords shooting in January 2011. And last night's episode, #5, was the death of bin Laden.

Notice what's been skipped? The release of the long-form, and the preceding interest in Birtherism due to Donald Trump. And I can't blame them. Even within the context of political news, it's a historical non-event. A sideshow with its own sorts of clowns.

They covered the assassination of bin laden in last night's show. I haven't watched it yet but if it was to get a mention it would be during that. Also I think they mentioned birthers in the 3rd episode
