Oh, he will. He has used the "you ain't the boss of me" defense before. It has always worked wonders for him.

Being a "repeat customer," I think FitzFundFilcher may find himself with more time as a guest of the state than he could imagine.

So Cordwood is seeking extraordinary relief from a court which he contends has no jurisdiction over anything. He is living with a woman who is a Grandma.

From Orlylicious' link:

Quote:
The letter delivered by Rush reads:

Comes the State of Tennessee, by and through the offices of R. Steven Bebb, District Attorney General for the Tenth Judicial district, and respectfully requests this court to disallow the defendant from wearing his uniform during official proceedings in this matter. The state would show that 1) the state has been in contact with the U.S. Navy, who states that wearing the uniform in this manner would bring disgrace to the uniform and to the U.S. Navy, and 2) that wearing the uniform in this manner is a blatant attempt to gain favoritism with the court and jury. Such communication may tend to bias the jury or cause them to consider factors outside the scope of this trial. As proof, the state asks Your Honor to consider that on the status date for Mr. Fitzpatrick, the defendant stated that he wore the uniform as a salute to Your Honor and your service in the military and your four bronze stars. Criminal proceedings should not be about saluting the judge or communicating with the jury about facts other than those at hand.

I love that.

I also like how Fitzfundfilcher is convinced that Mr. Bebb is no longer the DA because he's been "at home" for a few weeks. I suppose circumstances like illness, a death in the family, or a freaking vacation may be the explanation had never even crossed Wally's mind.

I can go in now and say, “This court has no jurisdiction if that’s what you’re going to keep calling it. If we’re not in a district court, you have no jurisdiction.” [cuz that worked so well last time] ...
And also because this is brand spankin' NEW argument, which THEY KNOW NOW. They can't deny it: They know. That's WAY much stronger than the stuff he tried in the past when he was telling them they had no jurisdiction for all those other garbled reasons. This explanation of why they have no jurisdiction is sure to work. :-bd

When Birthers spout their junk law theories on blogs it is fun. When they try to litigate them in civil cases and get sanctioned it is even more fun. But when they try to do it in a criminal case where their ass is on the line before a judge and jury it is the most fun of all. Thank you Walter. \:D/ Keep cheerleading him on Sharon Rondeau. =D>

Referring to a January 10, 2012 assignment hearing, Fitzpatrick said that at that time, he had asked Rush to “drop the case,” to which Rush had responded, “Oh, no, we’re not going to drop the case,” which charged Fitzpatrick with “tampering with government records,” although the documents were returned to a state trooper and FBI agent in February. According to the Tennessee 1984 law, the county court no longer has the authority to handle criminal charges.

This is news to me, I thought the docs were still missing. Did I miss them being noted returned? :-?

I don't think you did. That was the first I'd heard they'd been returned. Of course, as we know, they were not "missing" very long as Rondeau proudly announced she'd received them and even posted them on her rag.

The cops here "returned" merchandise from an equipment rental (chain saws/power equipment)...the perps are looking at 10 years.

That was posted before. I believe it was from an earlier article that Sharon wrote. I would love to know if she returned them after the FBI paid Sharon a visit.

But, but, he's a film critic now, and his appreciation of metaphor is awesome:

Quote:
If you’ve ever seen the movie “Titanic,” there is a scene in the movie of the evening when the ship hits the iceberg. In the moment before that part of the movie develops, there is a scene like the view that God had of the ship. You’re way high in the sky, and you’re looking down at this very dark and vast panorama, which is the sea, and this little dot, which is the royal mail ship Titanic, is steaming towards her fate. It represents that the ship is a very, very small part of the immense ocean. It gives you a perspective and appreciation that is global.

Wait a minute there Cordwood! I thought God was everywhere! Why is God's view of the Titanic limited to an overhead from far away? Sounds like Wally's religious edumacation stopped in Kindergarten. :-k

I'm tellin' ya, a guy who's as prescient as that ... I want him to be president, like, forever. What happens if space aliens attack? He'd know it first, know what I'm sayin'?

Oh Lordy! Thanks for the link. More whining by Cordwood as he is summarily rejected by a DA who he thought would be his ally. For a guy who was in the military, he sure is a wimp.

Walt is accusing others of being unable to read... ROTFL. Whether it is the fact that a judge in TN can appoint the foreperson of the jury and reappoint said person for consecutive times as he/she is not, technically speaking, a juror, or whether or not the District Court is a country Court when it is clear that the Court belongs to the Judicial District.
Walt is so confused about these trivial issues, and allows himself to get all worked up, resulting in him acting in a foolish manner, resulting in more jail time. The last time he stood up to leave the court room before the Judge was finished, the Judge, who was likely going to be lenient with Walt, had no reason but to award Walt with the full sentence.
