Under "Legal Miscomprehensions," she thought being shrouded by the Ninth Circuit was a GOOD thing; it meant her presentation was so clear and obviously correct that the judges listened in rapt attention and couldn't think of any questions that needed to be asked.

WONG KIM ARK IS NOT A CONTROLLING PRECEDENT

Kim Ark is not a controlling precedent for a number of reasons.

a. Kim Ark dealt only with citizenship in general. It never dealt with the definition of natural born citizenship.

d. Kim Ark was not an unanimous decision...

Actually, Orly never asked the Hawai'i 1st Circuit to do that. She asked the United States Court of Appeals for the 9th Circuit to have the State of Hawai'i's vital records seized and turned over to the military for safekeeping.
