For Taitz to win, the appellate court will have to either rule that Taitz did lay out a fraud claim in her complaint (including facts that show that she relied on alleged Dunn's misrepresentations) or that it was an abuse of discretion to dismiss her complaint without giving her the chance to amend and lay out the claim (with facts showing reliance).

Stern and others believe Judge Glass was right when he found that Taitz would not be able to amend her complaint to state a claim for fraud because she will never be able to claim she relied on Dunn's alleged misrepresentations. Me, I think I would have given her a shot at it, just for laughs.

I don't think she will win her appeal. I think she only survived the motion to strike because (WAG alert!) the motion was based on Taitz' technical violations of the rules and the motion to strike was flawed as well. If you want to hold someone to compliance with the little stuff, you better have your own house in order.

It probably varies from state to state, but when I lived in Nebraska, I knew a dentist who was able to prescribe some fairly potent pain killers.

As long as they have a DEA Registration Number they can write for Oxycontin #12 maybe, but usually go with 6 to 12 Percocet. Morphine tablets would be out of their range of practice. You can as a pharmacy get in deep doo doo filling a prescription from a dentist for 900 Oxycontin tablets. 2 CVS Pharmacies in Florida had a huge amount of narcotics sold versus the other stores in the area. They had their license to dispense pulled along with the wholesaler who sold the Oxycontin to the store.

I would bet dollars to donuts that Orly believes that -- once the corrupt judges, the corrupt Secretary of State, and the corrupt Governor rule in her favor -- the election must be done over. She will shirley win the election against Debra Bowen because everyone knows that she is Lady Liberty.

Another way to explain this delusional behavior is that she believes that she is getting good publicity out of this law suit.

Orly has to be in court with him, two days after MS. For us relative newbies, can someone summarize what this Court date -- for a suit that has gone on for years now -- is about? I know she filed charges that he wasn't a real Republican or something like that, but this is years later! Can he get her to cough up $$$ for her (surprise) litigious, frivolous filings?

April 18 is the date her suit against Dunn is to be submitted to the California Court of Appeal. (Whether there will be oral argument is another matter; it is still possible for the court to deem argument unnecessary the parties may wavie argument.)

In her suit, Taitz alleged that Dunn was not a registered republican (because he had not registered in a timely manner, and had previously registered long ago as a democrat in another state). This "fraud," Taitz alleges, induced her to spend ~$40k on her own vanity campaign. The trial court dismissed her complaint, without leave to amend (because amendment would have been futile).

Dunn will likely be awarded some sort of costs of appeal.

IIRC, April 18th is reserved for the second day of the Smackdown in Jackson Town if the hearing isn't completed on the 16th. (The courtroom wasn't available on the 17th at the time of scheduling order.)

Shirley, Orly can't expect to feenish in one day, can she? I mean, what with needing to voir dire Tepper for a few hours and then examining who-knows-how-many super-sekrit witnesses and reading the whole certified transcript of the Malihi Massacre into the record and...and...oh yeah, maybe Shurf Joe will reconsider and wander in with his posse.

Anyone know if the argument is on for tomorrow? In the unlikely chance that I can get away from my office for a few hours, I might enjoy my first chance to see and hear Lady Liberty in the flesh.(If I do, i will post a report on Fogbow, of course.)
