We spent weeks on Pennoyer v. Neff, which, at the end of the day, wasn't even good law anymore. For personal jurisdiction, become familiar with the phrase "International Shoe and its progeny."

As a quick aside, about 15 minutes before my Evidence final (after having skipped a fair portion of the classes to go skiing), I asked a classmate and friend to teach me everything I needed to know above Evidence in the next 15 minutes. Jesse Choper, then dean of the law school who was passing by as I spoke, said he could do it in 30 seconds (Jesse was pretty cool). I told him he was on and he said "Basically, if the probative value of the piece of evidence outweighs its prejudicial value, the court will find a way to let it in." Stern can tells us if that works in reality (I being a corporate and not a real lawyer), but it did get me honors on the final.

Professor Choper was pretty much correct. Except when a rule specifically commands exclusion, judges will try to let it in. Other than privileged information, there are exceptions to allow almost everything in if presented properly.

I'm sure that if she sends them some birfery comments made by an Alabama Supreme Court Justice and a statement by a federal judge that presidential eligibility is a federal issue, all the judges who have thrown her cases out will change their minds. Judge Carter will decide that Alan Keyes has most excellent standing. Judge Nishimura will decide that Hawaii statutes allow Orly to view Obama's original LFBC. ALJ Malihi will decide that all the fake evidence Orly and her fake experts presented is probative and compelling.
