Not prosecuted for contempt of court? No, not showing up was contempt of O'rly and O'rly Law. Not the same thing. The FM's may talk big about not showing up and blaming it on Obama, but I don't think anyone is stupid enough to actually put themselves at risk. Unless it's someone like the Fitzcommander who has totally lost it.

Yup, Orlylaw makes perfect sense. If you send someone else to court with a DVD instead of going yourself, here's what happens:

1. If the someone else is not a lawyer, the someone else can't speak to the judge on your behalf. Other than the poor spectators sitting next to this special someone, no one in the courtroom will hear the brilliant equal protection argument.

2. Meanwhile, the calendar is called. If the missing party is a civil defendant in small claims, the case will go on without them and they will lose the case. If it is a traffic case, a bench warrant will be issued for their arrest.

3. If the special someone makes a scene, they can end up in the pokey too, for contempt of court.

So far, Taitz has fought off disbarment. But maybe she's right and this thing will go viral in California. Maybe she can claim credit for that. And maybe those Cali folks who lost cases, money and liberty will be viewed by the State Bar as clients who have been actually harmed by her idiotic crusade.

Yeah, I know. Any day now.

Silly question #1983: Is it ethical for a lawyer to provoke or encourage breaking the law or civil disobedience? I can see defending it afterwards but not actively promoting it beforehand. One could look at it as a way to create business for one's own purposes and benefit.

No. It is extremely unethical and in a jurisdiction that actually enforced ethics rules, could get a lawyer disciplined or disbarred. It is arguable that providing advice on how best to engage in civil disobedience is not itself unethical, especially if it is connected to a challenge to the constitutionality of a statute, but that is a different issue. Orly is not doing that. What she is doing is giving incompetent, horrible legal advice that could get any fool dumb enough to follow Orly's advice in jail or, at the very least, lose them their case.

But then that's Orly, the most abject failure in the history of law.

If someone was stupid enough to follow Orly's advice. How long after they are released from jail can they sue for the legal equivalent of malpractice/bad legal advice? Look at the stock brokers. If they lose the client's money on clearly a loser, they may be liable.

I think a fool who followed Orly's advice would probably be screwed, at least in the absence of a retainer agreement of some kind. The question, I think, would be whether anyone could reasonably rely on such advice, and I don't think anyone could reasonably rely on the ravings of an obvious blithering cretin.

Note, the possibility of liability for giving bad legal advice is why most lawyers either will not give legal advice at all over the Internet or will put a half-dozen disclaimers on anything that even looks like it might be legal advice. Orly, perversely, is probably somewhat shielded from such liability by the fact that her statements are so clearly blisteringly stupid that nobody in their right mind would take them as advice from a competent lawyer.

That's a separate question, though, from whether she could be punished for encouraging such behavior, and I think she could be punished and would be by a functioning bar association.

I just know what I can see for free from the Orange County Courts online database, case number 30-2011-00518554-CU-BC-CJC. It was filed in October. It appears to be construction-related and it must be a mess because there are a dozen or so defendants and cross defendants. Oh, and there's a hearing scheduled for next Monday. :lol:

The OC court has made recent changes that make the online info nearly indecipherable, but I do not think that Yosi has an attorney working on this case. I haven't paid for the pleadings, but it looks to me like he and the missus filed with the purported dentist taking on the legal work.

There is only one participant identified as an attorney and it looks to me like they work for the
primary defendant, a general contractor who then turned around and cross-complained against a slew of subcontractors.

The initial case management conference was continued at least twice while they sort out who is who and who has been served. But eventually most of these construction cases end up in the OC's special "complex litigation" department. If you think Orly Taitz is a legal wiz, wait until you see her in that venue.
